AMF adjusts its annual and other fees

Montréal - As of January 1, 2013, the Autorité des marchés financiers (the AMF) will adjust certain annual and other fees payable pursuant to the laws it administers. These fees are, with exceptions, adjusted by operation of law on January 1 of each year pursuant to the Financial Administration ActThis link will open in a new window.Indexation corresponds to the annual change in the overall average Québec consumer price index without alcoholic beverages and tobacco products for the 12-month period ending on 30 September of the year preceding the year for which the fee is to be adjusted.

All adjusted fees are set out in two notices. The first notice was published in Part I of the Gazette officielle du QuébecThis link will open in a new window and section 1.1 of the AMF Bulletin

 

on December 13, 2012 (Vol. 9, No. 50). The second notice will be published in Part I of the Gazette officielle du QuébecThis link will open in a new window dated December 29, 2012. These fees are also on the AMF website under Fees payable to the AMF.

An Act respecting the distribution of financial products and services

Fees payable under the Regulation respecting fees and contributions payable of An Act respecting the distribution of financial services will be adjusted based on the rate of increase in the general Consumer Price Index (CPI) for Canada for the period ending September 30, 2012. The increase applicable as of January 1, 2013 will be 1.2%.

Fees in respect of the examination of a distribution guide prescribed by the Regulation respecting distribution without a representative (Regulation No. 8) will be adjusted by 2.48% as of the same date.

Money-Services Businesses Act

Fees and tariffs payable under the Regulation respecting fees and tariffs payable under the Money-Services Businesses Act will be adjusted by 1.2% as of January 1, 2013.

Securities Act

Fees payable under Chapter II of Title VI of the Securities Regulation will be adjusted by 2.48% as of January 1, 2013.

An Act respecting insurance Deposit Insurance Act An Act respecting trust companies and savings companies An Act respecting financial services cooperatives

Fees payable under the Regulation under the Act respecting insurance, the Regulation respecting the application of the Deposit Insurance Act, the Regulation under the Act respecting trust companies and savings companies and the Tariff of fees exigible under the Act respecting financial services cooperatives will also be adjusted by 2.48% as of January 1, 2013.

Derivatives Act

Fees payable under the Tariffs for costs and fees payable in respect of derivatives of the Derivatives Act will also be adjusted by 2.48% as of January 1, 2013.
