Credit assessment agents
This section is for credit assessment agentsA credit assessment agent means a personal information agent, within the meaning of the Act respecting the protection of personal information in the private sector, where designated by the Autorité des marchés financiers under the Credit Assessment Agents Act (the “CAAA”) (s. 2 CAAA). and for any personal information agentsA personal information agent means any person who, on a commercial basis, personally or through a representative, establishes files on other persons and prepares and communicates to third parties credit reports bearing on the character, reputation or solvency of the persons to whom the information contained in such files relates (s. 70 APPIPS). that the AMF may designate as credit assessment agents because of the significance of their business with authorized financial institutions or banks.
It contains information regarding obligations and responsibilities relating to credit assessment, including the disclosure requirements and guideline for credit assessment agents. The guideline sets out the expectations regarding actions that, in the AMF’s opinion, may be taken to satisfy the specific obligations of credit assessment agents. The expectations cover such areas as concerned persons’ rights, recourses and complaints, and the supervision and control of commercial practices and management practices.
