This section presents the Guideline Applicable to Credit assessment agentsA credit assessment agent means a personal information agent, within the meaning of the Act respecting the protection of personal information in the private sector, where designated by the Autorité des marchés financiers under the Credit Assessment Agents Act (the “CAAA”) (s. 2 CAAA). where designated by the AMF, the commercial practices and management practices of which are governed by the Credit Assessment Agents Act.

The guideline sets out the expectations that, in the AMF’s opinion, may be established to satisfy credit assessment agents’ obligations under Chapters III and IV of the Credit Assessment Agents Act This link will open in a new window. Those expectations relate, among other things, to concerned persons’ rights, recourses and complaints, and the supervision and control of commercial practices and management practices.

Credit assessment agents must comply with the applicable laws immediately upon their designation. The guideline takes immediate effect upon publication in the AMF’s Bulletin.
