PlexCoin - New orders issued against Dominic Lacroix, Sabrina Paradis-Royer and several individuals, institutions and businesses

Decisions and Freeze and cease trade orders Securities

Montréal – On May 24, 2018, at the request of the Autorité des marchés financiers (the “AMF”), the Financial Markets Administrative Tribunal (the “Tribunal”) issued various ex parte orders against Dominic Lacroix, Sabrina Paradis-Royer, Yan Ouellet, Pascal Lacroix, DL Innov inc., Gap Transit inc., Interaxe inc., Gestio inc. and several institutions and businesses impleaded in connection with their activities relating to an investment in PlexCoin, a cryptocurrency.

The Tribunal held that the prima facie evidence showed that [Translation] “there is no alternative in this matter given the repeated wrongdoing by the respondent Lacroix”, and that the respondents Lacroix and Paradis-Royer had maintained their lifestyle [Translation] “despite the freeze orders, the contempt of court ruling and the naming of a receiver.”

Although the Tribunal considered the previously issued freeze orders, which are still in effect, to be valid and to cover all the funds, securities or other assets held or controlled by the respondents Dominic Lacroix and Sabrina Paradis-Royer, it issued additional freeze orders to clarify the extent of the June 13, 2017 This link will open in a new window, July 20, 2017 This link will open in a new window and September 21, 2017 This link will open in a new window orders.

Specifically, the Tribunal ordered Dominic Lacroix, Sabrina Paradis-Royer, DL Innov inc., Gap Transit inc., Interaxe inc. and Gestio inc. not to dispose, directly or indirectly, of funds, securities or other assets, including any Bitcoin and/or other cryptocurrency, in their possession or under their control or which they hold or which have been entrusted to them, and Dominic Lacroix’s home in Québec City. The Tribunal also ordered them not to, directly or indirectly, withdraw or appropriate funds, securities or other assets, including any Bitcoin and/or other cryptocurrency, from any other person, company or trading platform which has them on deposit, under control or in safekeeping for them at any place whatsoever.

The Tribunal further ordered Dominic Lacroix to transfer any Bitcoin in his possession or under his control or which he holds or which has been entrusted to him to the portfolio address to be given him by the AMF when the decision is served on him, and indicated that the Bitcoins transferred to that address will remain covered by the freeze orders on Dominic Lacroix’s assets.

In addition, the Tribunal ordered Pascal Lacroix and Yan Ouellet not to dispose of funds, securities or other assets, including any Bitcoin or other cryptocurrency, they have in their possession or under their direct or indirect control, or which they hold on behalf of Dominic Lacroix, Sabrina Paradis-Royer, Micro-Prêts inc., DL Innov inc., Gap Transit inc. and Interaxe inc.

The Tribunal also ordered the impleaded parties BMO, Tangerine, Caisse Desjardins de Charlesbourg and CIBC not to dispose of funds, securities or other assets they have on deposit, under control or in safekeeping for Dominic Lacroix, Sabrina Paradis-Royer or Gap Transit inc.

The Tribunal also ordered the impleaded party Satoshi Portal inc. – Bylls not to dispose of funds, securities or other assets, including any Bitcoin and/or other cryptocurrency, it has on deposit, under control or in safekeeping for Dominic Lacroix, Pascal Lacroix and Yan Ouellet.

Lastly, the Tribunal ordered the registrar of the Land Registry Office for the registration division of Québec City to publish the freeze order relating to Dominic Lacroix’s Québec City home.

On May 28, 2018, Dominic Lacroix, Sabrina Paradis-Royer, DL Innov inc., Gap Transit inc. and Interaxe inc. appealed this decision and filed a motion to stay its provisional execution.

The Autorité des marchés financiers is the regulatory and oversight body for Québec’s financial sector.
