Montréal - The Autorité des marchés financiers (the "AMF") has filed 69 charges and is seeking fines totalling $952,000 with respect to Daniel Poulin, Respondent Daniel Poulin should not be confused with Daniel Poulin, independent insurance representative from Sherbrooke, holder of certificate 127630, or Daniel Poulin, financial planner and mutual fund dealer, holder of certificate 1638551. Claude Thibaudeau and Roch Champigny for their involvement in Eco6 and Fiducie Catholique les Anges de l'Air.
Daniel Poulin is facing 51 counts for acting illegally as a dealer, aiding with making distributions without a prospectus, making misrepresentations and for making distributions without a prospectus. Claude Thibaudeau faces 16 counts for acting illegally as a dealer and aiding with making distributions without a prospectus. For his part, Roch Champigny is facing two counts for illegal practice as a dealer and for making misrepresentations.
The three individuals convinced about 30 investors to invest in Eco6 by promising a guaranteed return. Eco6 had developed a unique technology consisting of a module that reduced gas consumption in combustion engines, as well as their harmful emissions. Some people also invested directly with Daniel Poulin, who promised them a return of 21% in 12 months. In April 2009, the company filed a notice of intent to file for bankruptcy, leaving the investors with no chance for reimbursement. Their losses are estimated at $1,470,000.
The investors' money passed through a trust named Fiducie Catholique les Anges de l'air, in which many cheques and bank drafts were deposited. This trust was also the only shareholder in Eco6.
