Capital P.V.M. inc. - Yvon Charbonneau(1), Jean-Yves Mulet and Lise Milot fined $37,000

Montréal – Yvon Charbonneau Respondent Yvon Charbonneau should not be confused with Yvon Cloutier-Charbonneau, the mutual funds dealer with National Bank Securities Mutual Funds in Laval, holder of certificate 171 831. , Jean-Yves Mulet and Lise Milot, who claim to be dealers associated with Capital P.V.M. inc., have been fined a total of $37,000 in connection with proceedings launched by the Autorité des marchés financiers (the "AMF") in July 2008.

Yvon Charbonneau
On October 8, 2009, in the Court of Québec (Criminal and Penal Division), district of Montréal, Judge Claude Leblond accepted a guilty plea by Yvon Charbonneau and ordered him to pay fines totalling $30,000.

Yvon Charbonneau pleaded guilty to 4 counts, 2 of which were for acting as a securities dealer without being registered as such with the regulatory authority, and 2 counts for aiding Capital P.V.M. inc. with illegal distributions. The fines imposed on him represent slightly more than double the minimum fine set by the Securities Act.

On January 30, 2009, Yvon Charbonneau was also found guilty on 6 counts for aiding Productions Action Motivation inc. with illegal distributions. A fine of $30,000 was imposed at the time.

Yvon Charbonneau was ordered to cease any activity in respect of a transaction in securities by the Bureau de décision et de révision en valeurs mobilières (the BDRVM) in April 2004.

Jean-Yves Mulet
On October 6, 2009, again in the matter of Capital PVM inc., in the Court of Québec (Criminal and Penal Division), district of Montréal, Judge Céline Lacerte-Lamontagne accepted a guilty plea by Jean-Yves Mulet on one count for illegal practice and ordered him to pay a fine of $1,000.

Jean-Yves Mulet was ordered to cease any activity in respect of a transaction in securities by the BDRVM on July 31, 2009. The AMF also launched another penal proceeding against him in May 2009 in the matter of Centre Financier Montérégie (C.F.M.), in which the AMF is seeking fines totalling $519,000 for 22 violations of the Securities Act.

Lise Milot
In the same matter, on October 13, 2009, Judge Michel Bellehumeur of the Court of Québec (Criminal and Penal Division), district of Montréal, found Lise Milot guilty on 2 counts of illegal practice and aiding with illegal distributions, and ordered her to pay fines totalling $6,000.

The AMF reminds consumers of the importance of investigating before they invest in financial products. More specifically, they should research the people who solicit them by contacting the AMF's Information Centre.
