AMF files 33 charges against Alain Valiquette and seeks $194,000 in fines

Montréal – The Autorité des marchés financiers (AMF) has launched penal proceedings in the Court of Québec (Criminal and Penal Division), district of Rouyn-Noranda, against Alain Valiquette.
As part of the proceedings, the AMF filed 33 charges against Alain Valiquette for:
- distributing a security without a prospectus approved by the regulatory authority, thereby violating 11 of the Securities Act, R.S.Q. c. V-1.1 (the "Act") (7 counts);
- acting as a securities dealer without being registered as such with the regulatory authority, thereby violating 148 of the Act (7 counts);
- representing that the price of the shares of Treegenic Corporation ("Treegenic") would be refunded if the shares were not listed on an exchange and declaring that the shares of Treegenic would be listed on an exchange, thereby violating subparagraphs 2 and 4 of the first paragraph of section 199 of the Act (7 and 9 counts, respectively);
- having communicated privileged information, namely, that an investor who purchased a share of Tom Exploration Inc. would receive a dividend in the form of a share of Treegenic, thereby violating section 188 of the Act (3 counts).
The AMF is seeking a fine of $194,000 plus costs, which is triple the minimum fine under the Act, in connection with these charges.
