Orders against François Baillargeon-Bouchard and Groupe financier Bouchard stayed
Insurance Decisions and Freeze and cease trade orders Securities
Montréal – On February 18, 2021, in connection with an application for judicial review filed by François Baillargeon-Bouchard, the Honourable Justice Benoit Moulin of the Superior Court of Québec, District of Québec, ordered a stay of the orders issued by the Financial Markets Administrative Tribunal (the “Tribunal”) in its decision of January 28, 2021, except for the conclusion pertaining to delivery of the client lists, which remains operative.
Judge Moulin ordered a stay of the order suspending François Baillargeon-Bouchard’s right to practise, authorizing him to resume his activities as a representative in insurance of persons and as a mutual fund dealer representative. A stay also applies to the order directing 9347-6760 Québec inc. (doing business as Groupe financier Bouchard) to appoint a responsible officer to replace Mr. Baillargeon-Bouchard.
The stay will remain in effect until June 2, 2021, the date of the hearing on the application for judicial review filed by François Baillargeon-Bouchard and Groupe financier Bouchard. It will then be up to the judge seized of the application for judicial review to renew the stay or not.
Update
François Baillargeon-Bouchard and Groupe financier Bouchard discontinued their application for judicial review on June 2, 2021 and did not file a new application for a stay. The decision rendered by the Tribunal on January 28, 2021 and, with it, all the orders against the defendants, including the order suspending François Baillargeon-Bouchard’s right to practise, are therefore operative again as of June 3, 2021.
