Integrity in Public Contracts Act - New contracts now covered under Act

Montréal - The Autorité des marchés financiers ("AMF") wishes to inform business enterprises bidding on 25 new contracts covered by the Order in Council - Certain contracts of Ville de Montréal (pdf - 45 KB)This link will open in a new windowUpdated on February 19, 2013 that they must first file an authorization application with the AMF by the bid submission deadline. They may now download the form and appendices (available in English soon) for assistance in preparing an application for authorization.

In addition, the AMF wishes to inform enterprises competing in a call for tenders for public-private partnership contracts and subcontracts for the purposes of a public infrastructure project equal to or greater than $40 million (pdf - 27 KB)This link will open in a new windowUpdated on February 19, 2013 that they also must file an authorization application with the AMF prior to entering into a contract, no later than the bid submission deadline.

Processing of applications related to certain contracts of Ville de Montréal listed in the Order in Council
The Ville de Montréal will analyze bids and forward the names of the two highest ranking tenderers to the AMF. The AMF will then process the applications of these two tenderers.

If a contract cannot be awarded to either tenderer, the AMF will process authorization applications filed by other tenderers based on their ranking, until the Ville de Montréal is able to award the contract.

Applications not processed by the AMF will be returned to tenderers.

Other enterprises
Enterprises not competing in a public call for tenders for contracts and subcontracts, including public-private partnership agreements, equal to or greater than $40 million and enterprises not bidding on one of the Ville de Montréal contracts listed in the Order in Council must wait before filing an authorization application. Applications by enterprises covered by Orders in Council pursuant to the Integrity in Public Contracts Act will be processed on a priority basis.
