Illegal use of title of Claims Adjuster - Fines imposed on Groupe drainage Québec inc. and Karl Rousseau

Montréal – In a decision handed down on May 4, 2009, Judge Hélène Bouillon of the Court of Québec (Criminal and Penal Division), district of Québec City, imposed fines totalling $5,250 on Groupe drainage Québec inc. and Karl Rousseau further to penal proceedings launched by the Autorité des marchés financiers (AMF) in April 2008.
Groupe drainage Québec inc., which was fined $4,500, pleaded guilty to each of the three counts brought against it for violating the Act respecting the distribution of financial products and services (the "Act"):
- by using the title of claims adjuster without being registered as such with the AMF, thereby violating sections 10, 70 and 71 of the Act, and committing an offence under section 462.
As for Karl Rousseau, he was fined $750 after pleading guilty to the charge brought against him for violating the Act:
- by aiding Groupe drainage Québec inc. with using the title of claims adjuster without being registered as such with the AMF, thereby violating sections 10, 70 and 71 of the Act, and committing an offence under sections 462 and 483.
Judge Bouillon acquitted Sylvain Ouellet, who was also on trial in the same matter.
The Autorité des marchés financiers (AMF) is the regulatory and oversight body for Québec's financial sector.
