Illegal practice as a dealer and distribution without a prospectus - Five individuals find $97,160

Montréal - On April 8, 2015, Justice of the Peace Nathalie Duperron Roy, of the Court of Québec for the district of Terrebonne, fined Alain Patrick Girard, Guy Martineau, Groupe financier Monexia inc., Gestion Monexia inc. and Fonds Monexia inc. a total of $97,160 further to penal proceedings launched by the Autorité des marchés financiers (the "AMF").

Guy Martineau, a director of Groupe financier Monexia inc., Gestion Monexia inc. and Fonds Monexia inc. at the time of the facts at issue, was found guilty on the 6 charges brought against him for illegal practice as a dealer (3 counts) and for making a distribution without a prospectus (3 counts). He was fined a total of $29,080. However, Mr. Martineau has appealed his conviction.

Alain Patrick Girard was also found guilty on 8 charges brought against him for illegal practice as a dealer (4 counts) and for making a distribution without a prospectus (4 counts). He was fined a total of $24,000.

Groupe financier Monexia inc., found guilty on 3 counts for illegal distribution, was fined a total of $15,000.

Gestion Monexia inc., found guilty on 3 counts for illegal distribution, was fined a total of $24,080.

Lastly, Fonds Monexia inc., found guilty on one count for illegal distribution, was fined $5,000.

Three investors lost a total of $210,000 in this matter.

The Autorité des marchés financiers (the "AMF") is the regulatory and oversight body for Québec's financial sector.
