At the end of the probationary period, the AMF expects the supervisor to take certain actions to finalize the trainee’s path toward obtaining a representative’s certificate.
This page explains how to submit your recommendation, what happens during the administrative period and what the potential consequences are if you fail to meet your obligations as a supervisor.
After the probationary period:
- you will need to assess the trainee’s competency development;
- you will need to submit your recommendation within 10 days;
- the recommendation will have to be submitted even if the trainee does not continue their career with the employer;
- if the trainee was supervised by two or more supervisors, a joint assessment will be required;
- only one of the supervisors will need to submit the recommendation;
- the employer will need to approve the recommendation;
- the AMF may request a copy of the trainee’s file; and
- the probationary certificate may remain valid during the administrative period.
Submit the supervisor’s recommendation
At the end of the probationary period, you will be required to assess the trainee’s competency development.
You will then have to submit the recommendation to the AMF via AMF E-ServicesIn AMF E-Services, follow these steps: Insurance, F. Pl. and Mortgage Brokerage > Probationary period – Supervisor > Manage probationary periods > Access the desired probationary period using the magnifying glass icon, then follow the instructions. or by mail within 10 days following the end of the probationary period. The recommendation may pertain to either:
- a specific sector; or
- a sector class.
It may be submitted once the minimum duration of the probationary period has been reached.
You will need to send the recommendation even if the trainee does not continue their career with the employer.
Your recommendation should be based on the development of the trainee’s competencies and their ability to perform the acts of an early-career representative.
You should provide feedback to the trainee:
- underscoring their progress;
- recognizing their strengths; and
- focusing on areas for improvement.
If two or more supervisors supervised the trainee, a joint competency development assessment will be required.
However, only one supervisor will have to submit the recommendation to the AMF. After the recommendation is prepared, it will need to be approved by the employer. The AMF may override the recommendation of successful completion of a probationary period on substantiated grounds.
Could the AMF seek clarification?
Yes. The AMF may seek clarification from the supervisor who sent the recommendation or request a copy of the trainee’s file:
- during the probationary period;
- at the end of the probationary period; or
- for up to five years following completion of the probationary period.
What do I do if the recommendation is negative?
If, based on one or more situations, you choose not to recommend successful completion of the probationary period, you will have to submit a negative recommendation along with the reasons for it.
A negative recommendation may cover either:
- a specific sector; or
- a sector class.
It may be submitted at any time. The situations that may result in a negative recommendation are presented in the Unsuccessful probationary period section.
Failure to submit the recommendation within the specified time may result in a notice of non-compliance being issued to you.
Not meeting an employer’s sales targets is not considered sufficient reason to refuse to recommend successful completion of the probationary period.
A positive recommendation does not create an obligation on the employer to offer a job to the future professional.
End of the warningAdministrative period
The probationary period is followed by an additional period, called the administrative period, during which the trainee’s certificate remains valid and the trainee remains under the same supervisor(s).
The probationary period ends when the supervisor’s recommendation is submitted or the maximum duration of the probationary period is reached.
During the administrative period, the trainee will no longer be required to work a maximum of 40 hours per week. However, all the other obligations will continue to apply.
If the probationary period is completed successfully, the trainee will be able to apply for a representative’s certificate.
If the application is received while the probationary certificate is still valid, the probationary certificate will remain in effect until the AMF makes a decision regarding the issuance of the representative’s certificate.
If the probationary period is not successfully completed
If the probationary period is not successfully completed, the trainee will have to stop acting as a trainee in the relevant sector or sector class.
If supervision changes during the administrative period
If a change in supervision is required during the administrative period, the employer will need to submit a Request to add or remove a supervisor before the change is made.
You will remain responsible for the trainee until their probationary certificate ceases to be valid.
Risks if a supervisor fails to meet their obligations
The AMF may ask to review the evidence of the work performed during the probationary period, including during an inspection.
If the AMF finds that there has been a failure to meet the obligations set out in sections 46 to 50 of the Regulation respecting the issuance and renewal of representatives’ certificates This link will open in a new window, it will send a written notice to the supervisor.
If a supervisor receives two written notices from the AMF for a failure to meet their obligations, the supervisor will have to:
- wait one year from the date of the last notice before they can act as a supervisor again; AND
- successfully complete an AMF-recognized professional development activity on trainee supervision.
No PDUs may be claimed for this professional development activity.
Post-probationary period checklist
After the probationary period, be sure to:
- assess the trainee’s competency development;
- consult with the other supervisors, if applicable;
- submit the recommendation within 10 days;
- provide reasons for the recommendation if it is negative;
- keep the trainee’s file;
- be prepared to provide clarification or a copy of the file to the AMF; and
- continue supervising the trainee during the administrative period until the probationary certificate ceases to be valid.
