This section will present the guideline applicable to AMF-designated credit assessment agentsA credit assessment agent means a personal information agent, within the meaning of the Act respecting the protection of personal information in the private sector, where designated by the Autorité des marchés financiers under the Credit Assessment Agents Act (the “CAAA”) (s. 2 CAAA)., the commercial practices and management practices of which are governed by the Credit Assessment Agents Act.

The guideline sets out the expectations that, in the AMF’s opinion, may be established to satisfy credit assessment agents’ obligations under Chapters III and IV of the Credit Assessment Agents Act. Those expectations relate, among other things, to concerned persons’ rights, recourses and complaints, and the supervision and control of commercial practices and management practices.

Credit assessment agents must comply with the applicable laws immediately upon their designation. A framework in the form of a guideline covering the commercial practices and management practices expected from these entities will be published in 2021 with immediate effect.
