Decisions and Freeze and cease trade orders Insurance

Montréal – In a decision issued on February 2, 2009, the Autorité des marchés financiers (AMF) ordered 9179-9064 Québec inc., an insurance of persons firm, to replace its responsible officer. A sanction has been imposed on the officer by the Chambre de la sécurité financière, and the AMF believes he no longer possesses the degree of honesty needed to pursue his activities.

Consequently, in view of the interests of the public and to ensure that such failures are not repeated and the Act respecting the distribution of financial products and services (Distribution Act) and its regulations are complied with, the AMF has imposed a penalty of $500 on the firm and is applying the following conditions to its registration:

  • The firm must replace Mr. Jacques-André Thibault, its current responsible officer;
  • Within 30 days after this decision has been served, it must provide the name of the responsible officer it intends to appoint;
  • The appointment of such officer must be approved in advance by the AMF in writing;
  • Mr. Thibault may no longer serve, directly or indirectly, as a responsible officer.

The Autorité des marchés financiers (AMF) is the regulatory and oversight body for Québec's financial sector.
