AMF action and interim freeze order

Montréal - On February 26, 2016, at the request of the Autorité des marchés financiers ("AMF"), the Bureau de décision et de révision ("Bureau") issued an interim freeze order against Me Jean-Paul Gagnon in respect of funds held in a trust account.

The order, which the respondent agreed to, prohibits him from disposing of the funds, securities or other assets that he has on deposit, under control or in safekeeping on behalf of Nicolas De Smet, Luc Roberge, Daniel Kaufmann or any investor referred by either of them or any entity controlled by either of them.

The AMF is currently conducting an investigation into various investments, particularly in connection with Iraqi dinars, involving Luc Roberge, who is now deceased, as well as Daniel Kaufmann and Nicolas De Smet. To date, the investigation has revealed that investors were encouraged to invest funds for the purpose of buying dinars through these three individuals, neither of whom is registered with the AMF. The investigation also revealed that the funds transited through the trust account of Me Jean-Paul Gagnon.
